Purpose and Scope

These General Terms and Conditions of Contract (hereinafter, “the Conditions”) govern the relationship between ELORA SMART SL (hereinafter, “ELORA SMART”) and the users who place orders or contract services through the website elorasmart.com (hereinafter, “the Website”).

Placing an order or requesting a quotation implies full and unreserved acceptance of these Conditions. ELORA SMART reserves the right to amend them at any time, the Conditions in force at the time of contracting being those that apply.

Purchase and Contracting Process

The products offered on the Website are intended for end consumers and authorised distributors. The purchase process is carried out as follows:

• The user selects the product or products of interest and adds them to the quotation basket.
• The user completes the contact form or quotation request form with their personal details.
• ELORA SMART sends the user a confirmation of the order or quotation by email.
• The contract of sale is concluded upon acceptance of the quotation and the corresponding payment.

ELORA SMART reserves the right to refuse an order on justified grounds, notifying the user as soon as possible.

Prices and VAT

All prices shown on the Website include the VAT in force applicable in Spain, unless expressly stated otherwise. Prices may change without prior notice; the price applicable is the one in force at the time the order is confirmed.

Shipping, installation and other additional service costs will be detailed in the individual quotation before the order is confirmed.

Payment Methods

ELORA SMART accepts the following payment methods:

• Credit/debit card: through ABANCA’s secure payment gateway, operated by Cecabank.
• PayPal: with your PayPal account.
• Deferred payment with seQura: subject to approval by seQura at the time of purchase.
• Bank transfer: bank details will be provided in the quotation.
• Financing: available under certain conditions; please consult the sales team.

ELORA SMART does not store bank card details. All card payments are processed securely through the Cecabank payment gateway, which complies with the PCI DSS standard.

Delivery Times

Estimated delivery times are indicated for each product and in the quotation. These times may vary depending on stock availability, the delivery area and logistical circumstances. ELORA SMART will inform the user of any significant change in the delivery time.

Warranty and Technical Support

All ELORA SMART products are subject to the warranty conditions described in our Warranty and Support Policy. In summary:

• 10-year warranty on ceramics for all models.
• 3-year warranty on technological spare parts for the ESENZA range.
• 5-year warranty on technological spare parts (ELORA Premium Care) for the AURA range.
• 10 years of spare parts availability from the date of purchase.

Right of Withdrawal

In accordance with Royal Legislative Decree 1/2007 (Consolidated Text of the General Law for the Protection of Consumers and Users), the user has the right to withdraw from the contract within 14 calendar days of receiving the product, without having to give any reason.

To exercise the right of withdrawal, the user must notify ELORA SMART by means of an unequivocal written statement sent to [email protected] or by post to the address given at the top of this document.

The right of withdrawal shall not apply in the following cases:

• Products that are personalised or made to the user’s specifications.
• Products that have been installed or show signs of use.
• Products whose seal has been removed, where they cannot be returned for reasons of hygiene or health protection.

Return costs shall be borne by the user, unless the reason is a manufacturing defect or an error by ELORA SMART.

Liability

ELORA SMART shall not be liable for any loss or damage arising from incorrect use of the product, installation that does not comply with the manufacturer’s instructions, or modifications made without express authorisation.

ELORA SMART’s maximum liability to the user shall in no case exceed the amount paid for the product or service that is the subject of the claim.

Intellectual Property

All content on the Website —texts, images, logos, designs, videos and audiovisual material— is the property of ELORA SMART SL or its licensors, and is protected by Spanish and international intellectual and industrial property legislation. Its reproduction, distribution or public communication without the prior written authorisation of ELORA SMART SL is prohibited.

Data Protection

The processing of personal data provided during the purchase process is governed by our Privacy Policy, which forms an integral part of these Conditions.

Amendments

ELORA SMART reserves the right to amend these Conditions at any time, as well as the prices, products and services offered. Changes will take effect from their publication on the Website, the conditions in force at the time of contracting being those that apply.

Applicable Law and Jurisdiction

These Conditions are governed by the Spanish legislation in force. For the resolution of any dispute arising from their interpretation or performance, the parties submit to the Courts and Tribunals of the city of A Coruña, expressly waiving any other jurisdiction that may correspond to them, unless consumer legislation establishes another mandatory jurisdiction.
